1. General Provisions
· For the purposes of these terms and conditions of use, “User” means the person who uses the services offered by the website www.obexsystems.com, whether they simply consult the information contained therein or proceed to use the reserved areas.

· The use of the site is governed by these conditions of use, acceptance of which constitutes an agreement between the User and the Owner and is lent by the mere fact of browsing the web pages.

· Further rules and conditions may be drawn up by the Controller to govern individual services offered on the Site: the User must comply with them in order to take advantage of the relevant goods and services.

· The law applicable to relations arising from the use of the service is the Italian law, in the light of which these conditions of use shall also be interpreted.

· The term Service Holder is used to refer unambiguously to Via XX Settembre, 42 – 30035 Mirano (VE).

· The Owner reserves the right to make changes, even substantial changes, to these conditions of use at any time, informing the User by publishing them on the Site.

· Access subsequent to the change implies full acceptance by the User of the new conditions of use.

2. Requirements and obligations of the User.

· Having activated the account, the User undertakes to use it, and in any case the associated user-id and password, lawfully and correctly, also in view of the legal consequences of such use.

· The User shall keep the user-id and password for his account with due care and diligence, and in the event of theft or loss, he shall promptly notify the latter and request their deactivation.

· The User is obliged to promptly notify the Controller of the loss or misappropriation of his/her access credentials (User-id and password): in the absence of such notification, all manifestations of will, acts and facts producing legal effects performed through the User’s account shall be indisputably attributed to the latter.

· Obex Systems Srl shall not be liable in any way for the illegitimate consultation of personal data contained in the reserved area by unauthorised third parties who have gained knowledge of the User’s authentication credentials through the User’s negligence.

· The User undertakes not to disrupt in any way, the use of the service by other Users.

· It is forbidden for the User to copy or otherwise learn the contents of the website, in any part, for uses other than strictly personal use and, in any case, for commercial use, without prejudice to the relevant provisions of copyright and/or industrial law.

4. Obligations, guarantees and exemptions from liability of the Controller.
· The Data Controller undertakes to provide the User with the online usability of the website and the services offered therein, as well as the communication tools connected thereto, taking care of their implementation in line with the current state of development of IT tools.

· Without prejudice to what has been established in the previous point, the Owner, in consideration of the fact that some pages of the Site are allocated on other people’s web spaces and managed by them, does not assume any responsibility for any possible interruption and/or suspension of the service provided and/or any other limitation of the usability of the service itself in any part, due to its own and/or third party technical problems generated by factors or circumstances beyond its control. In the event of problems in the operation of parts of the site, the user may report them to info@obexsystems.com.

· The Data Controller is entitled to use communication and/or publication tools that are alternative and/or ancillary to the Site, in order to make the services offered to Users
usable, also by employing, by way of example but not limited to, linking or mirroring techniques.

· The Owner will not be responsible for any use of this website and the services offered therein carried out in violation of the law, morality or public order, or in conflict with the provisions of these conditions of use.
The Owner does not guarantee the updating of the information entered on the site.

· The Owner does not exercise any control over links to other websites and their contents on its pages.
In the event that the link refers to a site that offers additional services through the Owner, the related use will be governed by the conditions of use prepared by the provider of the service itself.

· The Owner will not be responsible for any damage and/or loss and/or malfunction and/or prejudice of any kind that may arise to the User’s electronic computer following the use of the service provided by the same, nor for any contamination of the computer system resulting from access, interconnection, downloading of material and computer programs from the site; the related repair/restoration costs remain the responsibility of the User.
